with breaking news that you will only see right here on "360." after being the first to tell you that fbi investigators still have not set foot in the ruins of the american consulate in benghazi, libya, tonight we're the first to tell you why. tonight, we have the likely reason and we have it from a top law enforcement official. four americans as you know were murdered in the assault, one american ambassador, christopher stevens. that was two and a half weeks ago. two and a half weeks that have seen the administration first describe this as a spontaneous outburst even though our reporting revealed that officials knew within 24 hours that it was not. only much later did they back away from that assessment. today, the director of national intelligence, james clapper, put out a statement explaining that early evidence supported that theory so that's why they told the white house and congress. clapper says that throughout the investigation, his agency made it clear that the assessment was preliminary and could change. neither his statement nor our sources specify a time frame for the dni's ch

reporting also reveals that even though the administration says the investigation is going smoothly, the fbi has hit a bump in the road to the crime scene and tonight, we've got reporting that could explain why that is. a senior law enforcement official telling fran townsend the fbi wanted the u.s. military to provide perimeter support in benghazi, protection, in other words, but that request was not granted. fran's a former white house homeland security advisor. she served in the george w. bush administration, currently she sits on the cia external advisory panel and recently visited libya with her employer, mcandrews and forbes. also joining us, former fbi assistant director, tom fuentes, who has extensive experience investigating attacks on americans overseas, and former cia officer, bob baer. so fran, so the fbi sought military protection to go into benghazi. why didn't they get it? >> well, the answer to that question, i think, is not really clear. so it's not unusual, when you want to set up a security perimeter, you may look to the host country. if the host country is unable or unwill

with american citizenship and runs a big business in texas exported electronics, according to the fbi information. the fbi says what he was doing was purchasing very sophisticated electronics which are very useful in building weapons systems and weapons guidance systems and also radar systems. the electronics use a special licence. the allegations are that he was falsifying documents or not obtaining them at all and shipping all the electronics the moscow and then distributing them the weapons manufacturers, aircraft manufacturers, and to the successor to the kgb. analysis suggests that these electronics can be used in russian-made anti-ship missiles and fighter jets. they are buying electronics in america for those purposes. there has been a letter produced as part of the evidence in the case which seems to be from the ssb complaining that a batch of tips that had been provided by his company were faulty. that the evidence being presented to the judge. we will have to wait and see what the defendant has to say about it. >> that will be something to watch. thank you. still to come in

know, jarks, have you followed this -- everybody is waiting for the fbi to go to benghazi to find the people that killed our ambassador. but the fbi will not go to benghazi. they are in tripoli at our embassy there which has good security. they will not go to benghazi because the security is so awful. even now, 12, 14 days after the attack. so you have got to know that these al qaeda terrorist crazies, they knew that, and they were gunning for our ambassador and the white house was informed of it right away and they are covering that up, jack jacobs. >> it is absolutely true. now it's known the fbi is not only in benghazi, they are not going either. indeed it is even worse than that. there is a large number of witnesses whom they could interview in benghazi who will not go to tripoli to get interviewed by the fbi. they are very much concerned about their names being released, their families being in trouble. if they testify. they are not going anywhere. the fbi is not going to give any information from people who were on the ground and know what happened in benghazi. >> jennifer r

been down this road before. >> reporter: i have. we were back here in 2006 when fbi received what it believed to be a credible tip, and they dug at the horse farm quite a bit. they spent a lot of money doing so but didn't find anything. now they're working on another tip. as you can see what's going on just over our shoulder here, the digging has begun inside that shed. what the police department is doing with some expert help is digging a small hole in concrete inside there so they can fit in a drill to get a soil sample. then they hope to deliver that on monday to michigan state university to try to determine whether there are in fact human remains below there. the question of course is one of many questions. why do police think that the tipster in this case is credible? one reason why is that they said that he claimed that he saw what could have been a body being buried right here in this area around the same time that jimmy hoffa disappeared back in 1975. the police chief says the tipster never claimed that he saw jimmy hoffa being buried here, but the timing is in the vicinit

[♪...] ashley: the fbi is trying to determine who shot two border patrol agents killing 30-year-old agent and wounding another. the shooting took place in arizona, a drug trafficking core door 5 miles northeast of the border with mexico. the agents on routine patrol of horseback coming under fire, third agent was not hurt. the last agent fatally shot on duty was murdered back in 2010 with a gun link to operation fast and furious. just last month it was renamed in his honor. public-sector unions lining their pockets with taxpayer money the private sector struggles. taxpayers even picking up the tab for the time government employees spend working on union related manners resulting in $1 billion every year. joining me now, author of "the new york times" bestseller "shadow bosses." i guess the title says it all. what we're talking about is what they call officially time, this is time spent by government workers, government union workers working on union issues and not actually doing their worjob. >> 70% of the time they spend on general labor management

. the fbi is expected to investigate the fire as a possible act of domestic terrorism. jodi hernandez joins us in vallejo this evening with details. >> reporter: good evening. the mayor has faced a lot of challenges since taking office but nothing rises to this level. you can see the damage caused when an arsonist set fire to the mayor's private law office over the weekend. today mayor davis spoke for the first time about the torching calling it malicious and cowardly. >> although i believe that the last criminal act is part of an escalating attempt to intimidate me, let me make it very, very clear. it has failed. >> reporter: a defiant vallejo mayor says he went let saturday morning's arson fire that destroyed his private law office steer him off course but davis believes the torching was political. >> i will say that the number of acts of vandalism which i have been subjected to over the recent past causes me to believe that this incident is related to my position as mayor. >> reporter: the mayor would not elaborate but he's had his share of critics through the years. he got off to a rock
